Mizrahi Kroub LLP is one of the most active law firms in ADA website accessibility litigation. Plaintiffs represented include Rafael Cordero, Braulio Thorne, Kathleen Sypert, Ana Chalas, Roberta Feliz, Omar Rodriguez, Vivian Alvarez, Maricela Donet, and Jose Zarzuela.
The website accessibility claims in this complaint were ones we’re familiar with:
- missing alternative text
- website includes empty links without text
- dropdown links are not available through screen reader
- to properly navigate, the website necessitates the use of a mouse
- the website doesn’t have a way to bypass blocks (very likely a reference to a skip navigation link)
Note that when the claim of “not compatible with a screen reader” is made by any law firm, it is usually unclear exactly how the website is not compatible.
The claims were made in a complaint filed by William J. Downes (lawyer for Mizrahi Kroub) in the United States District Court Southern District of New York. Note that Edward Kroub also commonly signs complaints filed.
My ADA Compliance Course contains step-by-step instructions on how to find (audit) and fix (remediate) the most commonly claimed accessibility issues by plaintiffs’ lawyers (including William J. Downes).
